1. Agreement
These Terms and Conditions govern your use of mvhdrapery.ca and any products or services you purchase from MVH Drapery (“we”, “us”, “our”). By using this website, requesting a quote, placing an order, or opting in to our text messaging program, you agree to these terms.
Please read them alongside our Privacy Policy, which explains how we handle your personal information.

3. Use of this website
You may use this website for lawful purposes only. You agree not to interfere with its operation, attempt to gain unauthorised access to it, or use it in any way that could damage or overburden it.
Product images, descriptions and prices on this website are for general guidance. Colours and textures vary between screens and under different lighting, and fabric dye lots vary between production runs. We recommend viewing physical samples before ordering.
4. Quotes, measurements and custom orders
Quotes are valid for [NUMBER] days from the date issued unless stated otherwise, and are subject to final measurement and confirmation of product selections.
Custom-made products are manufactured to your specifications and cannot be resold. Once a custom order is confirmed and production has begun, it cannot be cancelled, returned or exchanged except where the product is defective or does not match the confirmed order.
Where we take the measurements, we are responsible for their accuracy. Where you supply the measurements, you are responsible for their accuracy, and we cannot accept returns or provide remakes for products that do not fit as a result.
Before production begins we will confirm your order in writing, including products, fabrics, colours, dimensions, control options and price. Please check this confirmation carefully — it is the document your order is made against.
5. Pricing and payment
All prices are in Canadian dollars and exclusive of applicable taxes unless stated otherwise.
A deposit of [PERCENTAGE]% is payable when a custom order is confirmed. The balance is due [WHEN BALANCE DUE]. We reserve the right to withhold installation or delivery until payment is received in full.
We may correct pricing errors at any time before an order is confirmed.
6. Installation
Installation dates are arranged with you in advance and are estimates. Delivery and installation timelines depend on manufacturing lead times and can be affected by supplier delays outside our control.
You are responsible for ensuring the installation area is accessible and clear on the scheduled date. If our installers cannot complete the work because access was not provided, a return visit may be chargeable.
We are not responsible for the condition or suitability of existing walls, window frames or mounting surfaces, or for damage arising from concealed wiring, pipework or defective building materials.
7. Cancellations, changes and warranty
Changes to a confirmed order may be possible before production begins and may affect the price and timeline. Once production has begun, changes are generally not possible.
Cancellations of custom orders are accepted only within [NUMBER] hours of order confirmation, and only where production has not begun. Deposits on cancelled custom orders may be non-refundable to the extent that costs have already been incurred.
Ready-made and stocked items in unused, original condition may be returned within [NUMBER] days of delivery. Return shipping is at your cost unless the item is defective.
Warranty. We warrant our fabrication and installation workmanship for [PERIOD] from the date of installation. Products carry the manufacturer’s own warranty, and manufacturer warranty claims are handled under those terms. Warranties do not cover normal wear, misuse, accidental damage, improper cleaning, or alterations made by anyone other than us.
8. Text messaging program
By providing your mobile number to MVH Drapery — through a form on this website, in person, or by phone — and agreeing to receive text messages, you consent to receive SMS messages from us at that number.
What we send. Appointment confirmations and reminders, quote and order updates, installation scheduling, and occasional promotional offers.
Message frequency. Message frequency varies depending on your enquiry and order activity.
Cost. Message and data rates may apply. These are charged by your mobile carrier, not by us.
How to opt out. Reply STOP to any message from us at any time. You will receive one confirmation message and then no further messages. You can also contact us directly at info@mvhdrapery.ca or (905) 286-8288 to be removed.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
Eligibility. You must be at least 18 years old, and the account holder or authorised user of the mobile number you provide.
Privacy. Your mobile number and opt-in consent are handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Consent to receive text messages is not a condition of purchasing any product or service from us.
9. Intellectual property
All content on this website — text, images, photographs, logos, layout and design — is owned by MVH Drapery or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute or create derivative works from it without our written permission.
10. Third-party links
This website may link to third-party websites. We provide those links for convenience and are not responsible for their content, products or practices.
11. Limitation of liability
To the fullest extent permitted by law, MVH Drapery is not liable for indirect, incidental, special or consequential losses arising from your use of this website, or from any product or service supplied by us.
Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law, including under the Consumer Protection Act, 2002 (Ontario).
12. Indemnity
You agree to indemnify MVH Drapery against any claim arising from your breach of these terms or your misuse of this website.
13. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute is subject to the exclusive jurisdiction of the courts of Ontario.
14. Changes to these terms
We may update these terms from time to time. The current version is always posted on this page with its effective date. Continued use of the website after a change means you accept the updated terms.
